La presente politica sulla privacy (di seguito, “Privacy Policy”) fornisce informazioni sul trattamento dei dati effettuato in relazione agli utenti (gli “Utenti”) che acquistano corsi (“Corsi”) da EIT Urban Mobility e TRT TRASPORTI E TERRIOTRIO SRL. 1. CHI SONO I TITOLARI DEL TRATTAMENTO DEI TUOI DATI?

I titolari del trattamento sono coloro che decidono lo scopo per cui i tuoi dati personali vengono trattati, in questo caso, sono EIT KIC Urban Mobility S.L (“EIT Urban Mobility”) con NIF B67513630 e sede legale presso Torres Glòries, Diagonal 211 Barcellona (08018) e indirizzo di contatto: info@eiturbanmobility.eu e TRT TRASPORTI E TERRIOTRIO SRL (TRT), P.IVA IT08578370150 con sede legale in Via Rutilia 10/8, Milano (20141), Italia e indirizzo di contatto: info@trt.it (di seguito, i “Titolari”).

2. QUALI DATI SONO TRATTATI DAI TITOLARI?

I dati personali (“Dati”) sono qualsiasi informazione relativa a una persona fisica identificata o identificabile (il “Titolare dei Dati”). I Dati Personali che i Titolari trattano derivano dalle informazioni che tu, in qualità di Utente, fornisci quando compili il modulo di registrazione al Corso.

Il modulo indica i dati obbligatori, con un asterisco. I dati non contrassegnati come obbligatori da un asterisco sono facoltativi. Vengono raccolti solo i Dati necessari per ciascuno scopo. Si prega di notare che se non fornisci le informazioni obbligatorie, i Titolari potrebbero non essere in grado di gestire la tua richiesta o di gestire il trattamento.

È tua responsabilità fornire dati accurati e mantenerli aggiornati, quindi i Titolari si riservano il diritto di escludere dall’acquisto e/o dalla registrazione dei Corsi gli Utenti che forniscono informazioni false, errate o non autorizzate, senza pregiudizio al diritto dei Titolari di intraprendere le relative azioni legali.

3. PER QUALI SCOPI TRATTIAMO I TUOI DATI PERSONALI?

I Titolari tratteranno i tuoi Dati per i seguenti scopi:

A. ACQUISTO O REGISTRAZIONE DEI CORSI. Quando acquisti o ti registri a un Corso, i Titolari possono utilizzare i tuoi Dati per gestire l’acquisto e la formazione, elaborare la registrazione al Corso, inviarti notifiche a riguardo, nonché per ottemperare agli obblighi legali applicabili. I Titolari tratteranno anche i tuoi Dati per contattarti in relazione all’acquisto e/o alla registrazione al Corso.

B. ACQUISIZIONE DELL’IMMAGINE. Quando partecipi al Corso, le lezioni potrebbero essere registrate e pubblicate sul profilo formativo dello studente. Anche se la registrazione si concentra sul personale docente, possono essere catturate immagini e/o voci degli studenti che interagiscono con loro. Possiamo anche raccogliere foto della tua partecipazione al Corso, quando fornisci il tuo consenso posando nelle foto. Si prega di notare che registrandoti a uno qualsiasi dei Corsi, autorizzi la cattura e/o la registrazione della tua immagine o di qualsiasi altro elemento di identificazione personale mediante fotografia e/o video e/o qualsiasi altro mezzo di cattura immagini che possono essere utilizzati. Allo stesso modo, i Titolari possono riprodurre e pubblicare l’immagine gratuitamente e con il diritto di trasferirla a terzi, in qualsiasi formato fotografico e/o video, nonché con qualsiasi altro mezzo di fissazione dell’immagine, nei nostri canali interni (come la piattaforma dove vengono forniti i Corsi), e i nostri canali esterni (come i nostri social media o il sito web).

C. MARKETING. Nel caso tu desideri ricevere comunicazioni da EIT urban Mobility e TRT, dai il tuo consenso compilando i moduli corrispondenti. EIT urban Mobility e TRT tratteranno i tuoi Dati allo scopo di gestire la consegna di tali comunicazioni.

4. QUAL È IL FONDO GIURIDICO PER IL TRATTAMENTO DEI TUOI DATI?

Questo articolo elenca i vostri principali diritti ai sensi del Regolamento generale sulla protezione dei dati (GDPR). Abbiamo cercato di riassumerli in modo chiaro e leggibile.

  1. Il fondamento giuridico per il trattamento dei tuoi Dati per l’acquisto e/o la registrazione ai Corsi è l’esecuzione del contratto e l’adempimento degli obblighi legali (come ad esempio, la segnalazione fiscale.).

Il fondamento giuridico per l’invio di comunicazioni commerciali in caso di consenso da parte tua, è il consenso che hai fornito registrandoti sui moduli corrispondenti, per tenerti informato sulle iniziative dei Titolari e sull’adempimento dei suoi obblighi legali.

Il fondamento giuridico per il trattamento dei tuoi Dati in relazione alla cattura di immagini e voci durante lo svolgimento dei Corsi e delle interazioni è il consenso che hai dato attraverso la registrazione nei moduli corrispondenti e/o mediante l’acquisto del Corso.

Ricorda che puoi revocare il tuo consenso in qualsiasi momento. Puoi anche opporsi a continuare a ricevere comunicazioni commerciali nel modo indicato nel piè di pagina di ciascuna comunicazione.

5. PER QUANTO TEMPO SARANNO CONSERVATI I TUOI DATI?

I tuoi Dati saranno conservati per il periodo di tempo necessario allo scopo per cui sono stati raccolti, e in particolare:

a. In relazione all’acquisto e/o alla registrazione ai Corsi, i tuoi dati saranno conservati per il tempo necessario per fornirti il Corso e consentirti di accedere ai materiali durante il periodo indicato al momento dell’acquisto, e successivamente saranno conservati bloccati per i periodi di conservazione prescritti dalla legge.

b. In relazione alle immagini raccolte durante lo sviluppo dei Corsi, esse saranno conservate fino a quando non richiederai la loro cancellazione. Si prega di notare che le immagini già pubblicate e/o incorporate nei materiali del Corso al momento della richiesta potrebbero non essere eliminate retroattivamente.

c. In relazione alla consegna delle comunicazioni, i dati saranno trattati fino a quando non revocerai il tuo consenso o ti opporrai al trattamento e/o per un massimo di due anni.

Una volta che i dati non sono più necessari allo scopo per cui sono stati trattati, saranno conservati bloccati esclusivamente per adempiere a eventuali responsabilità o obblighi che possono derivare dal trattamento degli stessi.

6. CHI SONO I DESTINATARI DEI DATI?

I tuoi dati possono essere comunicati a fornitori di servizi che assistono i Titolari nell’esercizio della loro attività, ad esempio, strumenti informatici, servizi di supporto tecnico, fornitori di pagamento, servizi finanziari, ecc. Possono anche essere comunicati a partner coinvolti nei Corsi e/o nella fornitura di altri servizi, alcuni dei quali potrebbero trovarsi al di fuori dello Spazio Economico Europeo (“SEE”).

    Quando i tuoi dati possono lasciare lo SEE, manterranno lo stesso livello di protezione in conformità alle disposizioni della legge europea sulla protezione dei dati. A tal fine, i trasferimenti internazionali dei dati saranno effettuati (i) verso Paesi con un adeguato livello di protezione dichiarato dalla Commissione europea (ii) sulla base della fornitura di garanzie adeguate (clausole contrattuali standard o vincolanti aziendali, o (iii) in virtù dell’autorizzazione dell’autorità di vigilanza competente o in base ad altre condizioni previste dalla normativa.

    Per ricevere ulteriori informazioni sui trasferimenti internazionali dei dati o per ottenere conferma o una copia delle garanzie utilizzate, puoi contattare info@eiturbanmobility.eu.

    Nei casi in cui sia necessario adempiere agli obblighi legali di EIT Urban Mobility, i dati potrebbero essere comunicati alla Pubblica Amministrazione e alle Forze di Sicurezza dello Stato.

    7. MISURE DI SICUREZZA

    I Titolari si impegnano a mantenere sicuri i tuoi dati personali, adottando tutte le misure ragionevoli a tal fine. I Titolari implementeranno tutte le misure organizzative e tecniche necessarie in conformità alle normative vigenti contro qualsiasi accesso e modifica non autorizzati, divulgazione, perdita o distruzione. Richiediamo e vincoliamo legalmente i nostri fornitori di servizi che potrebbero gestire i tuoi dati personali a fare altrettanto.

    8. QUALI SONO I TUOI DIRITTI?

    QUALI SONO I TUOI DIRITTI? In quanto proprietario dei tuoi dati, puoi richiedere conferma dai Titolari sul fatto che i tuoi dati vengano trattati e, in caso affermativo, l’accesso ad essi. Puoi anche richiedere la rettifica dei dati inesatti o, se del caso, chiedere la loro cancellazione quando, tra le altre ragioni, i dati non sono più necessari per gli scopi per cui sono stati raccolti.

      In determinate circostanze, puoi richiedere il limitazione del trattamento dei tuoi dati, in tal caso i Titolari li conserveranno solo per scopi legali o per la difesa di reclami.

      Puoi revocare il tuo consenso in qualsiasi momento, ma si prega di notare che non sarà retroattivo a meno che non sia diversamente richiesto dalla legge, e i tuoi dati potrebbero essere conservati bloccati per i periodi prescritti dalla legge applicabile. Puoi anche opporsi al trattamento dei tuoi dati, in tal caso non tratteremo i tuoi dati, tranne per motivi legittimi o per il trattamento di eventuali reclami.

      Allo stesso modo, se hai domande riguardanti l’esercizio dei tuoi diritti, prima di contattare l’Autorità di vigilanza, ti ricordiamo che, se desideri, puoi consultarli direttamente scrivendo ai Titolari. Hai anche il diritto di presentare reclamo all’autorità di protezione dei dati competente (in Spagna, www.aepd.es) nel caso in cui ti rendi conto o ritieni che un evento possa comportare una violazione delle normative sulla protezione dei dati applicabili.

      This privacy policy (hereinafter, “Privacy Policy”) informs you about the data processing carried out regarding users (the “Users”) who purchase courses (“Courses”) from EIT Urban Mobility and TRT TRASPORTI E TERRIOTRIO SRL.       1. WHO ARE THE DATA CONTROLLERS OF YOUR DATA?

      2. WHAT DATA ARE PROCESSED BY THE CONTROLLERS?

      Personal data (“Data”) is any information about an identified or identifiable natural person (the “Data Subject”) The Personal Data that the Controllers process comes from the information that you as a User provide when you fill in the Course registration.

      The form indicates the data that is mandatory, with an asterisk. Data that are not marked as mandatory by an asterisk are optional. Only the Data necessary for each purpose are collected. Please note that if you do not provide the mandatory information, the Controllers may not be able to deal with your query or request or to manage the processing.

      It is your responsibility to provide accurate data and keep them updated, so the Controllers reserve the right to exclude Users who provide false, incorrect or unauthorised information from purchasing and/or register of the Courses, without prejudice to the right of the Responsible Parties to take the corresponding legal action.

      3. FOR WHAT PURPOSE DO WE PROCESS YOUR PERSONAL DATA?

      The Controllers will process your Data for the following purposes:

      1. PURCHASE OR REGISTER OF COURSES. When you purchase or register to a Course, the Controllers may use your Data to manage the purchase and the training, to process the registration for the Course, to send you notifications about the same, as well as to comply with the applicable legal obligations. The Controllers will also process your Data to contact you in relation to the purchase and/or register to the Course.
      2. IMAGE CAPTURE. When you attend the Course, the classes may be recorded and posted on the student’s training profile. Although the recording focuses on the teaching staff, images and/or voices of the students interacting with them may be captured. We can also collect pictures of your participation in the Course, when you provide your consent by posing in the photos. Please note that by registering for any of the Courses, you authorise the capture and/or recording of your image or any other personal identification element by means of photography and/or video and/or any other means of capturing images that may be used. Likewise, the Controllers may reproduce and publish the image free of charge and with the right to transfer it to third parties, in any photographic and/or video formats, as well as by any other means of image fixation, in our internal channels (such as the platform where the Courses are given), and our external channels (such as our social media or website).
      3. MARKETING. In case you wish to receive communications from EIT urban Mobility and TRT you give your consent by filling the corresponding forms. EIT urban Mobility and TRT will process your Data for the purpose of managing the delivery of such communications.

      4. WHAT IS THE LEGAL BASIS FOR PROCESSING YOUR DATA?

      The legal basis for the processing of your Data for the purchase and/or register to the Courses is the execution of the contract and the fulfilment of legal obligations (such as, for example, tax reporting.).

      The legal basis for sending commercial communications in case you consent it, is the consent you have given by registering on the corresponding forms. keep you informed about the Controllers’ initiatives and compliance with its legal obligations.

      The legal basis for the processing of your Data in relation to the capture of image and voice during the development of the Courses and interactions is the consent you have given through the registration in the corresponding forms and/or by purchasing the Course.

      Remember that you can revoke your consent at any time. You may also object to continue receiving commercial communications in the manner indicated in the footer of each communication.

      5. HOW LONG WILL BE YOUR DATA KEPT?

      Your Data will be kept for the period of time necessary for the purpose for which they were collected, and specifically:

      1. In relation to the purchase and/or register to the Courses, your Data will be kept for the time necessary to provide you the Course and to allow you to access the materials of it during the period indicated when you make the purchase, and thereafter will be kept blocked for the legally prescribed retention periods.
      2. In relation to the images collected during the development of the Courses, they will be kept until you request their deletion. Please note that images that have already been published and/or incorporated into Course´s or promotional materials at the time of the request may not be deleted retroactively.
      3. In relation to the delivery of communications, the Data will be processed until you revoke your consent or object to the processing and/or for a maximum of two years.

      Once the Data are no longer necessary for the purpose for which they are processed, they will remain blocked for the sole purpose of meeting any liability or obligations that may arise from the processing thereof.

      6. WHO ARE THE DATA RECIPIENTS?

      Your Data may be communicated to service providers that assist the Controllers in carrying out their business, for example, IT tools, technical support services, payment providers, financial services, etc. It may also be communicated to partners involved in the Courses and/or the provision of other services, some of which might be located outside the European Economic Area (“EEA”).

      When your Data may leave the EEA, they will maintain the same level of protection based on compliance with the provisions of European data protection law. In this regard, international transfers of Data will be made (i) to countries with an adequate level of protection declared by the European Commission (ii) on the basis of the provision of adequate safeguards (standard contractual clauses or binding corporate, or (iii) by virtue of authorisation by the competent supervisory authority or under other conditions provided for in the regulations.

      In cases where it is necessary to comply with EIT Urban Mobility’s legal obligations, the Data may be communicated to the Public Administration and the State Security Forces and Corps.

      7. SECURITY MEASURES

      The Controllers are committed to keep your personal data secure, taking all reasonable measures to do so. The Controllers will implement all necessary organizational and technical measures in accordance with the regulations in force against any unauthorized access and modification, disclosure, loss or destruction. We demand and legally bind our service providers who may handle your personal data to do the same.

      8. WHAT ARE YOUR RIGHTS?

      As the owner of your Data, you may request confirmation from the Controllers regarding whether your Data are being processed and, if so, access to it. You can also request the rectification of inaccurate Data or, where appropriate, request its deletion when, among other reasons, the Data is no longer necessary for the purposes for which it was collected.

      In certain circumstances, you may request the limitation of the processing of your Data, in which case the Controllers will only retain them for the purpose of legal proceedings or the defence of claims.

      You may revoke your consent at any time, but please note that it will not be retroactive unless otherwise required by law, and your data may be kept blocked for the prescription periods established by the applicable regulations.

      You may also oppose the processing of your data, in which case we will not process your data, except for compelling legitimate reasons or for processing possible complaints.

      Likewise, if you have any questions regarding the exercise of your rights, before contacting the Supervisory Authority, we remind you that, if you wish, you can consult them directly by writing to the Controllers. You also have the right to lodge a complaint to the competent data protection authority (in Spain, www.aepd.es) in the event that you become aware of or consider that an event may involve a breach of the applicable data protection regulations.
